Davis EIS Enterprise LLC (“Davis EIS,” “we,” “our,” or “us”) respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our websites, use our logistics and technology platforms, communicate with us—including by text message via 10‑Digit Long Code (“10DLC”)—or otherwise engage with our services (collectively, the “Services”).

By accessing or using the Services, you acknowledge that you have read, understood, and agree to the practices described in this Policy. If you do not agree with our practices, please do not use the Services.

This Policy applies to personal information we collect online and offline, including information collected through our websites, mobile applications, driver apps, customer portals, email, telephone, SMS messaging, social media pages, trade shows, and other interactions with you.

Sensitive Personal Information. We do not intentionally collect or process sensitive personal information (as defined under applicable law) except where strictly necessary for compliance or as expressly provided by you (e.g., driver’s license for security clearance at facilities).

3. How We Use Information

We use the information we collect to:

  1. Provide & Operate the Services – fulfill shipments, route optimization, real‑time tracking, account creation, 24/7 customer support, and invoicing;

  2. Facilitate 10DLC SMS and Other Communications – send service‑related alerts (e.g., shipment status), two‑factor authentication codes, and promotional offers where permitted;

  3. Improve & Develop new features, analytics dashboards, and sustainability tools;

  4. Ensure Security & Integrity – prevent fraud, protect our networks, enforce our terms, and monitor compliance with industry regulations;

  5. Comply with Legal Obligations – transportation, customs, trade, tax, accounting, and environmental reporting requirements;

  6. Market Our Services – with your consent or as otherwise permitted by law, including email newsletters, event invitations, and surveys;

  7. Support Corporate Transactions – business transfers, mergers, acquisitions, or financing.

We rely on the following legal bases, as applicable: (a) performance of a contract; (b) legitimate interests that are not overridden by your rights; (c) your consent; and (d) compliance with legal obligations.

4. 10DLC SMS Messaging & Compliance

Davis EIS uses 10‑digit long codes to send application‑to‑person (A2P) SMS/MMS within the U.S. We adhere to:

  1. Explicit Opt‑In prior to messaging.
  2. Clear Brand Identification in each message.
  3. STOP/UNSUBSCRIBE opt‑out processed within one business day.
  4. HELP keyword for support info.
  5. Disclosed Frequency not exceeded without renewed consent.
  6. Content Restrictions per CTIA/carrier guidelines.
  7. Data Privacy – secure storage of numbers and logs; no sale to third parties.
  8. Security – encryption in transit/at rest.
  9. Retention – message logs kept ≤ 24 months unless longer retention required.
  10. Regulatory Compliance – active brand/campaign registrations and carrier cooperation during audits.

 

5. Cookies & Tracking Technologies

We use cookies, pixel tags, and similar technologies to recognize your browser, improve site performance, remember preferences, and measure marketing effectiveness. You can control cookies through browser settings; however, disabling cookies may affect functionality.

6. Sharing & Disclosure

We may share your information with:

  • Service Providers & Sub‑Processors – cloud hosting, carrier partners, payment processors, SMS gateway providers, analytics companies, and IT support, bound by confidentiality and data‑processing agreements;

  • Business Partners & Clients – limited logistics data necessary to fulfill shipments or integrate systems;

  • Legal & Regulatory Authorities – when required by law, subpoena, or to protect rights, property, or safety;

  • Corporate Transactions – potential buyers, advisors, or other third parties in connection with a merger, acquisition, or asset sale, subject to confidentiality.

We do not sell or rent personal information for monetary value.

7. International Data Transfers

We are headquartered in the United States and may transfer your information to countries that may not provide the same level of data protection. We use approved safeguards (e.g., Standard Contractual Clauses) where required.

8. Data Security

We employ technical, administrative, and physical safeguards such as TLS encryption, role‑based access controls, ISO 27001‑aligned policies, and regular penetration testing. No method of transmission is 100% secure; therefore, we cannot guarantee absolute security.

9. Data Retention

We retain personal information for as long as necessary to fulfill the purposes outlined in this Policy, comply with legal obligations (e.g., FMCSA recordkeeping, tax requirements), resolve disputes, and enforce agreements. 10DLC message logs are retained for 24 months unless a longer period is required by carriers or law.

10. Your Rights & Choices

Depending on your jurisdiction, you may have the right to:

  • Access the personal information we hold about you;

  • Correct inaccurate or incomplete information;

  • Delete your data, subject to exemptions (e.g., legal or contractual requirements);

  • Opt‑Out of marketing communications and certain data processing;

  • Data Portability – obtain a copy of your information in a structured, machine‑readable format;

  • Restrict or Object to processing in certain circumstances.

11. Children’s Privacy

Our Services are not directed to children under 13, and we do not knowingly collect personal information from them. If we learn that we have inadvertently collected such data, we will delete it promptly.

12. Changes to This Policy

We may update this Policy periodically. We will post the revised version with a new “Last Updated” date. Material changes will be communicated through prominent notices or direct communications where appropriate.
